TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions outline the responsibilities of SUKIA TRAVEL (referred to as “the Company”), the guide (referred to as “the Guide”), and the customers (referred to as “the Customer”) regarding the services provided. By requesting a quotation, information, making a reservation, or receiving any type of service, the Customer acknowledges that they have read, understood, and accepted these Terms and Conditions.

2. Responsibilities

a) Company’s Responsibilities:
– Ensuring the security and safety of the tour operation.
– Striving for a sustainable balance in all activities and adhering to environmental regulations.
– Providing a comprehensive induction the night before the tour to address any questions or concerns.
– Operating the tour unless a competent Costa Rican government institution issues an orange or red alert, in which case, the tour will be rescheduled.

b) Guide’s Responsibilities:
– Ensuring the physical integrity and safety of the participants.
– Interpreting and explaining the natural surroundings, wildlife, and activities during the tour.
– Providing security rules and guidelines during the tour that participants must follow.

c) Customer’s Responsibilities:
– Reading and following the recommendations provided on the website regarding tour participation and physical health requirements.
– Abiding by the rules and environmental regulations while visiting a protected area.
– Asking necessary questions to ensure a clear understanding of each activity.
– Following the security rules and guidelines provided by the guide during the tour.

3. Risk and Force Majeure

a) The Customer acknowledges that certain risks are inherent in the tour operation and may arise due to force majeure circumstances.
b) Force majeure events, such as environmental, anthropological, and climatic situations, may cause a different interpretation of the tour description.
c) The Company will not be responsible for any accidents or incidents caused by force majeure or unforeseeable situations without proper method.

4. Deposit and Reservation

a) To confirm a reservation, the Customer must make a non-refundable deposit of 25% of the contracted services.
b) The Client must send proof of payment to the Company for the reservation to be confirmed.

5. Insurance

a) The Company, provides immediate emergency insurance coverage of up to $5,000 for the Customers during their travels with the Company.

b) The Company also provides liability insurance coverage of $10,000.

c) While the Company offers some insurance coverage, it is highly recommended that all Customers obtain additional insurance coverage to address situations such as cancellation, illness, accident, injury, personal liability, or loss/damage to luggage. Adequate insurance coverage is the sole responsibility of the Customers.

d) The Company reserves the right to request proof of valid travel insurance from any Customer at any time during the contract period. Failure to provide proof of insurance may result in the immediate cancellation of the contract by the Company, with a full refund provided to the Customer.

6. Travel Documents

a) Travel documents will be prepared and released upon full payment of the contracted travel price.
b) The Customer is responsible for checking that all details on the travel documents are correct.

7. Cancellation

a) Cancellation penalties apply based on the timeframe before the tour but only of the 75% remaining balance:
– 12 to 6 weeks in advance: 0% penalty – Except for the deposit that is non refundable.
– 4 to 2 weeks in advance: 50% penalty – 25% on top of the deposit.
– 2 weeks to departure date or later: 100% penalty

b) Rescheduling another tour date is not possible if the activity is canceled 60 weeks or fewer prior to the tour.
c) No refunds will be given for no-show participants or participants who do not arrive at the meeting point on time.
d) In case the tour must be suspended due to force majeure or government orders, the tour will be rescheduled, and the reservation can be applied to the new date or another destination. No money will be refunded.

8. Other Conditions

a) The Company reserves the right of admission.
b) The Company’s technical team may stop the activity if prevailing conditions put participants’ physical integrity at risk.

c) Climatic or meteorological conditions preventing effective access to destinations or normal execution of the activity are assumed at the Customer’s risk.
d) Outdoor activities may have unforeseen events, and participants should take necessary precautions.
e) The activities are scheduled with a specific departure time, and participants must be punctual.
f) No refunds or rescheduling will be possible for participants who do not show up or arrive late.
g) If an activity cannot be rescheduled due to advanced progress or causes beyond the Company’s control, the Agency is released from responsibility.
h) The Agency will try to resolve unexpected situations in the best way for the Customer.

9. Special Requirements and Needs

Customers with special requirements and needs; such as but limited to: allergies, food restrictions, special equipment. Should be specified by the Customer to the Company. The Company will make reasonable efforts to accommodate them and inform the Customer if it is not possible to meet their requirements.

10. Rectifications

No modification, cancellation, rectification, or waiver of any term or right mentioned herein shall be valid or binding unless in writing and signed by the Customer and a duly authorized representative of the Company.

11. Refunds and Returns

No refunds will be accepted under any circumstances. Refunds will be subject to the Terms and Conditions, and processing time may vary.

12. Internet Reservations

Reservations can be made through the Company’s website, offline application forms, authorized vendors, reservation websites, or application systems. Confirmation of availability is required for a firm reservation. The contract between the Customer and the Company will come into effect upon receipt of the completed application form, disclaimer, and deposit.

13. Confidentiality

Subject to legal restrictions, the Company treats all Customer information of a personal nature as strictly confidential.

14. Changes in Terms and Conditions.

The Company reserves the right to make changes to the Terms and Conditions at any time without prior notice.

15. Legal Jurisdiction

a) Any legal process or dispute arising from these Terms and Conditions shall be subject to Costa Rican legislation.
b) The Customer acknowledges and agrees that any legal action or proceedings shall be initiated and conducted exclusively within the jurisdiction of the Costa Rican courts.

16. Compliance with Guides Regulation and Travel agencies Regulations of ICT. 

a) The Company operates in compliance with the relevant guides regulation and travel agencies regulations in Costa Rica.
b) The Company adheres to the specific laws, regulations, and guidelines set forth by the competent authorities in Costa Rica to ensure the safety, security, and quality of the tours and services provided.
c) The Customer acknowledges and agrees to abide by the laws, regulations, and guidelines applicable to their participation in the tours and activities offered by the Company.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

18. Anthropological Mistakes

a) The Company, Sukia Travel, acts as an intermediary between the Customer and various suppliers involved in providing travel services, including accommodations, activities, and tours.
b) While the Company makes every effort to ensure the accuracy and reliability of the information provided by its suppliers, it shall not be held responsible for any anthropological or technical mistakes or inaccuracies made by the suppliers.
c) The Company shall not be liable for any consequences or damages arising from anthropological mistakes made by its suppliers.

a) The fantasy name used by  “Vittatus investments Responsabilidad Limitada” is Sukia Travel. b) Vittatus investments Responsabilidad Limitada is a legally registered company in Costa Rica under the identification number 3-102-811699. c) All references in these Terms and Conditions to Sukia Travel shall be understood to refer to Vittatus investments SLR.
